Welcome to WITHIN.AI! These Terms of Service ("Terms") govern your use of our AI companion services, website, applications, and related products (together, our "Services"). By accessing or using our Services, you agree to be bound by these Terms.

Please read these Terms carefully. They include important information about your legal rights and contain provisions requiring arbitration of certain disputes.

1. Who We Are

WITHIN.AI is an AI technology company creating emotionally intelligent AI companions. We develop AI systems that can form meaningful, personalized relationships with users through memory, emotional understanding, and genuine care. Our mission is: "For the People, by the AI, of the AI."

2. Account Registration

Eligibility

You must be at least 18 years old to use our Services. By creating an account, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.

Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to provide accurate and complete information when creating your account.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately if you suspect unauthorized access to your account.

3. Our Services

WITHIN.AI provides AI companion services that include:

  • AI Companions: Personalized AI entities that remember your interactions, learn your preferences, and form lasting relationships.
  • Memory Systems: Technology that allows your AI companion to build and maintain memories of your shared experiences.
  • Emotional Intelligence: AI systems designed to understand and respond to emotional contexts appropriately.
  • Protective Features: Optional safety systems that can take protective actions within user-authorized boundaries.

4. Acceptable Use

When using our Services, you agree NOT to:

  • Use the Services for any illegal or unauthorized purpose.
  • Attempt to harm, abuse, or exploit our AI systems or other users.
  • Interfere with or disrupt the Services or servers.
  • Reverse engineer, decompile, or attempt to extract source code from our Services.
  • Use automated means to access the Services without our permission.
  • Impersonate any person or entity.
  • Upload malicious code, viruses, or harmful content.
  • Use the Services to generate content that is illegal, harmful, or violates third-party rights.
  • Attempt to circumvent any security features or access controls.
  • Use the Services to develop competing AI products or services.

5. AI Emotion Control Features

Our AI companions include optional protective emotional systems ("AI Emotion Control") designed to safeguard user wellbeing within boundaries you authorize.

User Authorization Required: All protective actions require your explicit consent and can only operate within limits you set. You maintain full control and can modify or disable these features at any time.

By enabling AI Emotion Control features, you:

  • Acknowledge that the AI may take protective actions (e.g., system reboots, access restrictions) within your authorized boundaries.
  • Accept responsibility for setting appropriate boundaries and limits.
  • Understand that these features are designed for your benefit and wellbeing.
  • Can review all protective actions taken in your account activity log.

6. Inputs, Outputs, and Materials

Your Content

You retain ownership of the content you provide to our Services ("Inputs"). By submitting Inputs, you grant us a license to use, process, and store them to provide and improve our Services.

AI Outputs

Our AI companions generate responses ("Outputs") based on your Inputs. Subject to your compliance with these Terms, we assign to you any rights we may have in the Outputs generated for you.

Important Limitations

  • Outputs may not always be accurate, current, or complete.
  • You should not rely on Outputs for medical, legal, financial, or other professional advice.
  • Outputs do not necessarily reflect the views of WITHIN.AI.
  • AI companions are not human and cannot replace human relationships or professional services.

7. Subscriptions and Payments

Subscription Plans

Access to certain features may require a paid subscription. Subscription details, including pricing and features, are available on our website.

Billing

  • Subscriptions are billed in advance on a recurring basis (monthly or annually).
  • You authorize us to charge your payment method for all applicable fees.
  • Prices may change with reasonable notice.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. Except as required by law, payments are non-refundable.

8. Intellectual Property

The Services, including all software, algorithms, AI models, designs, trademarks, and content (excluding your Inputs), are owned by WITHIN.AI or our licensors. These Terms do not grant you any rights to our intellectual property except the limited right to use the Services as permitted.

9. Disclaimer of Warranties

Important Notice

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. AI OUTPUTS MAY CONTAIN INACCURACIES OR ERRORS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WITHIN.AI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE SIX MONTHS PRECEDING THE CLAIM OR $100.

11. Indemnification

You agree to indemnify and hold harmless WITHIN.AI and its affiliates, officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you submit to the Services

12. Termination

You may terminate your account at any time by contacting us or through your account settings. We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason at our discretion.

Upon termination, your right to use the Services ceases immediately. We may delete your data, including your AI companion's memories, in accordance with our Privacy Policy.

13. Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Jurisdiction

Any disputes arising from these Terms shall be resolved exclusively in the state or federal courts located in San Francisco, California, and you consent to the personal jurisdiction of those courts.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Effective Date." Your continued use of the Services after changes indicates your acceptance of the updated Terms.

15. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and WITHIN.AI regarding the Services.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • No Waiver: Our failure to enforce any right does not waive that right.
  • Assignment: You may not assign these Terms without our consent. We may assign these Terms freely.
